This section deals with injuries that have occurred because of the negligence of another person or company. Some of the injuries that I help individuals and families with are:
· Amputations
· Severe cuts and burns
· Traumatic brain injury
· Lower back injuries (often involving herniated discs)
· Spinal cord injuries (such as paralysis)
· Burn Injuries
· Loss of Eyesight or Loss of Hearing
These injuries can overlap with other areas of personal injury. For example, in car accidents a person may suffer one or all of these injuries. The injuries can also occur because of a dog bite, a doctor's negligence, and while at work.
Damages
There are two broad categories of damages available: Economic and Non-Economic. Damages for pain and suffering fall into the non-economic category. Following is a break-down of the types of harm covered under economic and non-economic damages:
In serious or catastrophic injury cases, economic damages may include:
- Medical expenses – past and future
- Past lost income
- Future lost income, reduced to present value
- Lost support and services
- Any other economic loss that would not have occurred but for the injury
Non-economic damages may include:
- Pain and suffering
- Mental anguish
- Inconvenience
Statute of Limitations
In Florida, a person must bring a medical malpractice claim within two (2) years from the date of the incident or from the date the injury should have been discovered. A wrongful death claim and a claim under the nursing home statute also have this same limitation of two (2) years. Dog bites and normal negligence cases have a limitation of four (4) years including cases arising out of defective products.
